Muhammad Essa V. District Judge, Pishin and 14 others,

CLC 2014 1288 · Balochistan High Court

This case involved a dispute over a pre-emption suit, a type of case where someone claims the legal right to purchase property that a family member or co-owner has sold to someone else, usually by matching the sale price.

The buyer of the disputed property (the petitioner) had purchased land, and the plaintiff filed a pre-emption suit to claim the property by offering to pay the same price, which was stated as Rs. 29,00,000 in the plaint. Later, the plaintiff sought to amend the plaint, apparently trying to alter details related to the sale consideration. The trial court refused to allow this amendment, but the plaintiff challenged that refusal before the District Judge, who reversed the trial court and permitted the amendment. The buyer then challenged the District Judge's order before the High Court.

The High Court ruled in favor of the buyer. It found that since the value of the suit property (Rs. 29,00,000) exceeded the monetary limit for the District Judge's revisional jurisdiction, the District Judge had no legal authority to even hear the case. Separately, the court also held that the plaintiff could not be allowed to change the sale price he had already committed to in the original plaint, since doing so would unfairly shift the fundamental nature of his claim after the fact, a legal principle preventing parties from taking contradictory positions.

The petition was allowed, the District Judge's order was set aside, and the amendment application was dismissed. This case reinforces the principles of jurisdictional limits and preventing inconsistent legal claims by litigants.
