Gohram alias Ali Gohar and another V. Mst. Zar Bano alias Zero through L.Rs. and others,
CLC 2014 1126 · Balochistan High Court
This case involved a family land dispute in Balochistan. The petitioners, Gohram and Ali Akbar, claimed that their father and his brother had jointly purchased several pieces of land using their combined earnings, but the property documents were only put in the brother's name. They said that when their father moved away due to drought, he left the land in the care of a relative, Mst. Zar Bano, to cultivate on their behalf, and that they continued to receive a share of the proceeds for years. They later discovered that the revenue records showed the land registered in the names of Zar Bano and other relatives, and they claimed this was the result of fraud. They sued for a court declaration confirming their ownership and for possession of the land.
The lower courts dismissed the suit, and that dismissal was upheld on appeal. The petitioners then brought this revision petition before the Balochistan High Court.
The High Court also dismissed the case. It found that the petitioners had waited too long to sue, since a claim like this must be filed within six years of when the right to challenge the ownership first arose, and the petitioners could not show when their title was actually denied. More importantly, they failed to produce any real evidence proving their ownership: their names did not appear on the property agreements, no documents supported their claimed title, and they could not prove the old agreements were genuine. The court reaffirmed that revenue records don't create ownership by themselves but are simply presumed accurate until proven otherwise. Since the petitioners couldn't rebut that presumption, their case failed.
