Habibullah v. Managing Editor and Resident Director Daily Jang,

CLC 2013 940 · Balochistan High Court

This case comes from the Balochistan High Court and involves a dispute between a construction contractor and a newspaper company that had hired him to build on its property. The contractor had completed about 80% of the work when the project stalled due to the owner's financial troubles. Years later, in 2008, the owner allegedly forced the contractor's watchmen off the site and took over possession by force. The contractor filed a police report and then sued for restoration of possession.

The trial court, without taking any evidence from either side, rejected the contractor's plaint (essentially dismissing the case at a preliminary stage) based on a claim by the owner that a later agreement between the parties had already settled the matter and required the contractor to hand back possession. This decision was upheld on appeal.

The High Court found this approach improper. It held that courts cannot reject a plaint based on the defendant's unproven claims and defenses, especially on a disputed factual issue like whether a settlement agreement existed and applied. Since no evidence had actually been presented to prove the alleged agreement, dismissing the case was premature and unfair to the contractor.

The High Court therefore declared the lower courts' orders illegal, and sent the case back to the trial court to be properly decided on its merits after both sides present evidence. This case reinforces the principle that factual disputes must be resolved through evidence, not shortcuts.
