Bibi Rukhsana v. Abdul Malik Khan & others.,

CLC 2013 871 · Balochistan High Court

This case is about a pre-emption suit, a right recognized under Islamic law that allows a neighbouring property owner to buy land before it is sold to someone else, provided certain formal steps (called talbs) are strictly followed at the right time and in the right manner.

Bibi Rukhsana claimed she owned a house next to an open plot that had been sold by one respondent to another. She argued she had a right to buy that plot instead, and said her attorney had performed the required talbs (formal demands asserting the pre-emption right) immediately upon learning of the sale. The trial court believed her and ruled in her favour, but the Additional District Judge overturned that decision on appeal, finding her claim was not properly proven, and the case reached the Balochistan High Court on revision.

The High Court upheld the appellate court's decision and dismissed the suit. It found that the record showed a long, unexplained delay between when the pre-emptor's son learned of the sale and when the first talb was supposedly made, and that no proper witnesses or explanations were provided to support the claim. The court reaffirmed the settled principle that pre-emption rights must be exercised strictly and promptly according to Islamic law's exact requirements; sloppy or delayed conduct forfeits the right, since the law favours the vigilant, not the negligent.

This case matters because it reinforces that pre-emption claims are treated strictly by courts, and failure to follow the precise legal formalities and timelines can defeat an otherwise valid claim.
