Niaz Muhammad v. Muhammad Amin,
CLC 2013 46 · Balochistan High Court
This case involved a petition challenging the eligibility of a Member of the Balochistan Provincial Assembly, who had also served as a provincial minister. Under the election rules then in force, candidates needed a bachelor's degree to contest elections. The petitioner alleged that the respondent had not actually taken his B.A. exams himself; instead, another person impersonated him in the examination hall and sat the papers on his behalf, allowing him to fraudulently obtain the degree used to qualify for office.
The Balochistan High Court examined records from the University of Balochistan, including examination forms and certificates, which showed the photograph of the other individual (not the respondent) on the official documents. The court also noted that after being elected, the respondent had rewarded this individual with a government job, reinforcing suspicion of collusion. The court concluded that the degree was indeed obtained through impersonation and fraud, making it invalid, and ruled that the respondent could not be considered a graduate.
As a result, the court declared his election null and void, ordered the Election Commission to remove him from office, hold a by-election, and file a criminal case against him. He was also directed to return salaries and benefits received during his time in office, and the university was told to cancel the fraudulent degree and take action against those involved.
This case matters because it shows courts can intervene under constitutional jurisdiction to ensure only genuinely qualified individuals hold public office, especially when fraud is clearly documented.
