CLC 2013 343 · Balochistan High Court
This case is about whether police in Pakistan can register a First Information Report (FIR) against a Pakistani citizen for an offence that actually took place outside Pakistan. The petitioner, Muhammad Majid, was accused under section 489-F of the Pakistan Penal Code (dishonestly issuing a cheque) after cheques he issued to the complainant bounced at a bank in Dubai. He asked the Balochistan High Court to quash the FIR, arguing that local police had no jurisdiction over an offence committed abroad, and that section 188 of the Criminal Procedure Code requires special government or political-agent certification before such a case can even proceed.
The court explained that Pakistani law does allow citizens to be tried in Pakistan for offences committed abroad, under sections 3 and 4 of the Penal Code and section 188 of the Criminal Procedure Code. However, the requirement to obtain certification or sanction under section 188 only applies before the case can be formally "inquired into" or tried in court, not before an FIR is registered or investigated by police. This sanction can be obtained later, even after the police complete their investigation and file charges.
Since the bar in law applies only to trial/inquiry stage and not registration, the court refused to quash the FIR. It ruled that the complainant and police could proceed to seek the necessary government sanction while continuing the investigation, and dismissed the petitioner's application.
