Muhammad Saddique and others V. Secretary Forest through Executive Officer, Lasbella at Uthal and others,
CLC 2013 1902 · Balochistan High Court
This case involved a land dispute in Lasbela, Balochistan, between the Forest Department and local residents (petitioners) over land recorded as government forest property. The Forest Department claimed ownership of the land based on a 1965 government notification allotting it forest land, later formally mutated in the department's name in 1980. It alleged that local residents had illegally cut trees and built structures on this land, and sued for declaration, injunction, and eviction. The residents argued they were in long-standing possession of part of the land, treating it as ancestral property, and that mere revenue records should not override their possession.
Both the trial court and the appellate court (Majlis-e-Shoora) ruled in favor of the Forest Department, finding the land belonged to the government and had been properly transferred to the department. The residents then approached the Balochistan High Court through revision petitions.
The High Court upheld the lower courts' decisions, ruling that courts should not disturb "concurrent findings of fact" by two lower courts unless those findings are clearly unreasonable or the evidence was misread. Since the residents' lawyer could not point to specific evidence that was overlooked or misinterpreted, the court dismissed the revision petitions.
The case is important because it reinforces limits on higher court intervention in factual disputes already decided consistently by two lower courts, and it clarifies how principles like res judicata apply when a party's claim has already been litigated and lost in an earlier related case.
