Malik Mehboob V. Nazar Muhammad and 3 others,

CLC 2013 1865 · Balochistan High Court

This case is about a property dispute in Quetta. The petitioner, Malik Mehboob, claimed he was in possession of a piece of land and filed a lawsuit seeking an injunction to stop the actual owners and a revenue official from entering the land or carrying out a demarcation (division) of the property. He argued that he had occupied vacant land in 1980 by building walls around it, and that no one had objected at the time.

Both the trial court and the first appellate court rejected his case, finding that he was not the owner and had essentially occupied the land as a trespasser without the owner's permission. The revenue record showed the respondents were the actual joint owners in possession, and they had lawfully asked a revenue officer to carry out demarcation of the land. The courts held that a revenue officer cannot be restrained from performing his lawful duties under the West Pakistan Land Revenue Act, and that mere illegal or unauthorized possession does not create a legal right against the true owner.

The Balochistan High Court, reviewing the case, agreed with the lower courts' findings. It found no error, unfairness, or misreading of evidence in their decisions and refused to interfere with the concurrent findings of fact. The revision petition was dismissed.

The case matters because it reaffirms that unauthorized possession alone does not defeat an owner's rights, and that courts will not block lawful actions by revenue officials or restrain rightful owners from accessing their own property.
