Muhammad Arif and another V. Yar Muhammad,

CLC 2013 1757 · Balochistan High Court

This case involved a dispute between a man (Yar Muhammad) and his former brother-in-law and another person over a written agreement supposedly made when Yar Muhammad's marriage to the sister of one of the petitioners ended through khula (a form of divorce initiated by the wife). Yar Muhammad claimed the agreement obliged the family to pay him Rs. 225,000 as compensation, with one relative acting as guarantor. When payment was not made, he sued for enforcement of the agreement.

The trial court dismissed his suit, finding the agreement was not properly proved, since key witnesses to the document were never produced in court. However, an appellate religious court (Majlis-e-Shoora) later ruled in his favor, issuing an ex parte decree without proper notice to the other side.

The Balochistan High Court found serious flaws in this outcome. It noted that the underlying claim made no legal sense, since khula and its financial terms only arise during a subsisting marriage, and this marriage had already been legally dissolved. The appellate court also failed to notice that no court fee had been paid, a mandatory requirement for filing the case.

The High Court set aside the appellate court's decision and restored the trial court's dismissal of the case, while also directing recovery of the unpaid court fees. The case highlights the importance of properly proving contested agreements and following procedural requirements like court fees before a court can decide a case.
