Muhammad Rafique and others V. Bibi Asifa and others,

CLC 2013 1446 · Balochistan High Court

This case involved a family dispute over inherited property in Quetta. The plaintiffs, some legal heirs of the deceased Haji Pir Muhammad, sued for a declaration of their inheritance rights and a share of the estate. The defendants claimed the property had already been divided during the deceased's lifetime, based on a registered Will he had executed, and argued the plaintiffs had no remaining claim.

The Balochistan High Court examined two connected revision petitions. On the question of the Will and the alleged earlier partition, the court found the defendants had failed to prove their case. They did not produce the witnesses who had signed the Will, no one confirmed that a partition process had actually taken place, and the signatures on the Will were never verified. Because of this lack of solid evidence, the courts below were right to rule that the Will and partition were not proven, and the plaintiffs' suit for a share of the inheritance was upheld.

On the separate issue of mesne profits (compensation for use of property), the court held that a co-sharer who is in possession of joint family property is not automatically in "wrongful possession" just because other heirs are excluded from using it, unless there is proof of deliberate ouster. Since no such proof existed here, the appellate court's decision to award mesne profits to the plaintiffs was set aside.

This judgment matters because it clarifies the evidentiary burden needed to prove a Will and partition, and explains when co-sharers can be held liable for profits from shared property.
