Syed Zia-Ud-Din and another V. Shabir Ahmed and others,

CLC 2013 1395 · Balochistan High Court

This case from the Balochistan High Court dealt with a dispute over a car sold under an installment agreement. The buyer had agreed to pay Rs. 7 lac for a Toyota Corolla, paying only Rs. 50,000 upfront, with the remaining Rs. 6.5 lac due after two years, backed by a guarantor. When the balance was not paid, the seller sued and won an ex parte decree ordering the buyer and guarantor to pay the outstanding amount plus a fine, and barring the vehicle's registration from being transferred.

During execution of this money decree, the seller had police seize the vehicle from a third party, Shabbir Ahmed, who claimed he had legitimately purchased the car from someone else entirely. Ahmed argued he was a bona fide purchaser unconnected to the original defendants and sought to have the car returned to him.

The High Court found that the trial court's decree was only for recovery of money, not for handing over the vehicle itself, and it never authorized seizing the car from a third party. The execution court had failed to follow proper legal procedure for enforcing money decrees, which requires attaching and selling the judgment-debtors' own property, not simply seizing a vehicle from someone who wasn't a party to the original case. The court ruled that Ahmed's possession must be restored, while the decree-holder could still pursue proper execution methods within the actual terms of the decree. The ruling reinforces that courts must strictly follow prescribed legal procedures and cannot go beyond what a decree actually orders.
