Muhammad Ismail v. State,

CLC 2013 1335 · Balochistan High Court

This case involved the death of Sher Zaman, who was fatally shot during a confrontation at a shop in Quetta on 7 August 2005. According to the prosecution, a minor quarrel between family members escalated when the accused, Muhammad Ismail, along with two others armed with a pistol and sticks, attacked the deceased. Ismail allegedly shot Sher Zaman, who later died of his injuries. The trial court convicted Ismail under section 302(b) of the Pakistan Penal Code and sentenced him to death, while acquitting two co-accused, Shams-ul-Haq and Haji Zarif Khan.

Three matters came before the Balochistan High Court together: Ismail's appeal against his conviction, the mandatory reference to confirm his death sentence, and the complainant's appeal against the acquittal of the other two men.

The High Court upheld Ismail's conviction, finding the eyewitness accounts credible and well-supported by medical evidence, recovery of the weapon, and forensic reports, despite witnesses being relatives of the deceased. However, since the killing arose from a sudden quarrel rather than premeditation, and Ismail lacked clear intention to kill, the court held that a death sentence was too harsh. It reduced the sentence to life imprisonment, while keeping the compensation order intact. The court also dismissed the acquittal appeal, agreeing that the prosecution had unfairly tried to implicate the entire family without sufficient evidence against the other two men.
