CLC 2013 1261 · Balochistan High Court

This case from the Balochistan High Court concerned a long-running property dispute over land in Kharan. The original plaintiffs (respondents in this appeal) claimed ownership of certain land, alleging that government officials had wrongfully conspired to allot their ancestral land to a private party (the petitioners). The trial court (Qazi, Kharan) had dismissed their suit, partly because the plaintiffs themselves never testified as witnesses, though several relatives and associates testified on their behalf. On appeal, the Majlis-e-Shoora, Kharan reversed this decision and ruled in favor of the plaintiffs, prompting the losing parties to file revision petitions before the High Court.

The petitioners argued that the plaintiffs had improperly changed their case through an amended plaint (introducing a new claim that the land was "Shamilat/Noutor" community land) without court permission, that the witness testimony was contradictory and unreliable, and that the plaintiffs' failure to testify personally was fatal to their case.

The court's key legal points included that evidence supporting claims never actually made in the original pleadings should be disregarded, that amending pleadings to introduce new claims without court approval is improper, and that while a party's failure to testify isn't automatically fatal if other evidence supports their case, it does prevent their own pleadings from being treated as evidence. The judgment also emphasized that courts have a special duty to protect public property and public rights against questionable administrative actions.

درخواست گزاروں کا مؤقف تھا کہ مدعیان نے عدالت کی اجازت کے بغیر اپنے دعوے میں ترمیم کر ک
