Malak Muhammad Noor through Attorney V. Mst. Bibi Rabia and 2 others,

CLC 2013 1004 · Balochistan High Court

This case involved a property dispute between two sisters who jointly owned land in Quetta. One sister, Bibi Rabia, filed a lawsuit claiming that a general power of attorney used to sell her share of the property was fraudulent - she alleged it was prepared by affixing her thumb impression without her real consent, and that her signature-holder then sold her share to the petitioner. She asked the court to declare the sale invalid, cancel the power of attorney, and correct official land records to restore her ownership.

The trial court and the first appellate court both ruled in her favor, finding that the power of attorney and subsequent sale were fraudulent. The buyer of the property then challenged these decisions before the Balochistan High Court, arguing technical objections: that the burden of proof was wrongly placed on him, that the case was filed too late, and that a mere declaration suit was not valid without also seeking possession of the property.

The High Court rejected these arguments. It held that a co-owner does not need to include the other co-owner as a party when claiming her own share. It also ruled that when fraud is alleged against a registered power of attorney, the person alleging fraud carries the initial burden of proof, but strong evidence is needed to overturn such a registered document - and here the lower courts had properly found that burden was met. Importantly, the court emphasized that since both lower courts had already reached the same factual conclusions, the High Court could not disturb these findings in a revision petition. The petition was dismissed, and the sister's ownership claim was upheld.
