Haji Tor Khan v Government of Balochistan,

CLC 2012 669 · Balochistan High Court

This case involved a land dispute between private individuals (the petitioners) and the Government of Balochistan over ownership and possession of a piece of land. The government filed a suit claiming ownership of the land, arguing that the petitioners' possession was unauthorized and illegal. The petitioners argued they had rightfully purchased the land from previous owners, had been in possession for generations, built houses and shops on it, installed tube wells, and that the government's long silence about their occupation amounted to acceptance of their rights. They also raised technical objections, including that the suit was filed too late (barred by limitation), that not all persons in possession of the land were included as parties, and that the property description in the plaint was inadequate.

Lower courts (a Senior Civil Judge and an Additional District Judge on appeal) both ruled in favor of the government, and the petitioners then challenged this in the Balochistan High Court through a civil revision petition.

The High Court dismissed the petition. It found that the land was officially recorded in government revenue records, which was not disputed by the petitioners. While the petitioners claimed to have purchased the land, they failed to produce any valid title documents proving their sellers actually owned the land or had legal title to sell. Mere possession, without proof of legal title, was not sufficient to defeat the recorded ownership.

This case reinforces an important principle: physical possession of land alone does not establish ownership, and anyone claiming purchase-based title must prove their sellers had valid, provable ownership.
