Haji Attaullah Baloch v. Asadullah Baloch,

CLC 2012 469 · Balochistan High Court

This case involves a challenge to a 2008 Balochistan provincial assembly election. Haji Attaullah Baloch, who lost to Asadullah Baloch by a narrow margin, filed an election petition asking the court to void the results of one polling station, or the entire election, alleging serious irregularities.

The petitioner claimed that the winning candidate, a former District Nazim with local influence, had the original Presiding Officer at a key polling station replaced at the last minute with his own real uncle, without proper approval. He alleged this Presiding Officer then rigged the process: his polling agent was beaten and thrown out, unidentified people voted without identity cards, the officer himself allegedly stamped ballots in favor of the respondent, and vote counts didn't match up with other records.

The Election Tribunal, however, found that most of the petitioner's evidence was circumstantial rather than direct proof of wrongdoing. While the blood relationship between the winning candidate and the Presiding Officer was acknowledged, the court held that this alone doesn't invalidate an election unless it's proven the appointment was manipulated with intent to secure an unfair result. No witness testified to actual vote-rigging or manipulation of results, and the law itself states that a candidate's or agent's absence doesn't automatically invalidate election proceedings. Since the petitioner failed to prove corrupt practice or undue influence with sufficient evidence, the tribunal dismissed the petition, upholding the original election result.
