CLC 2012 316 · Balochistan High Court
This case involved a property dispute between two parties over land where one man had installed a flour grinding machine that allegedly damaged his neighbor's well. Rather than pursue lengthy litigation, the parties signed a written agreement to have their dispute settled by two private arbitrators outside the court system. The agreement stated that if either party failed to honor the arbitrators' decision, the other could sue them after paying a Rs.500,000 penalty. The arbitrators investigated the site, heard both sides, and ordered the machine's owner to remove it from the disputed land. Both parties signed the award accepting it, and a related criminal case was withdrawn as part of the settlement. However, the losing party later refused to comply and rejected the award. The winning party then sued in the Majlis-e-Shoora court to enforce the agreement, and won. The losing party appealed to the Balochistan High Court, arguing the suit was not maintainable and that proper court fees had not been paid.
The High Court dismissed the appeal. It held that although a private arbitration award is not the same as a formal award under the Arbitration Act, when parties voluntarily agree to resolve a dispute through arbitrators, participate in the process, and then accept the resulting decision by signing it, the legal principle of estoppel prevents them from later going back on that agreement. The court also found the required court fee had in fact been paid. This case matters because it reinforces that people who voluntarily submit to private dispute resolution and accept the outcome cannot later disown it simply because it wasn't issued through formal court arbitration proced
