CLC 2012 287 · Balochistan High Court
This case involved a man convicted of murdering his brother-in-law with a dagger. He was sentenced by a trial court in Quetta to life imprisonment under section 302(b) of the Pakistan Penal Code, along with a fine payable to the deceased's heirs. He appealed the conviction, while the complainant separately sought enhancement of his sentence.
The Balochistan High Court found a serious procedural flaw in the trial. During the trial, the defence lawyer had tried to cross-examine the Investigating Officer about earlier statements made by prosecution witnesses to the police, pointing out contradictions and improvements in their court testimony. The trial judge had refused to allow this line of questioning, which the High Court held was a clear violation of Article 140 of the Qanun-e-Shahadat Order, 1984 (the law of evidence), which lays down a specific procedure for confronting witnesses and investigators with prior statements to test their credibility.
The High Court ruled that skipping this required procedure was not a minor irregularity but a fundamental unfairness that prejudiced the accused's right to a fair trial. It set aside the conviction and sent the case back to the trial court, directing it to re-examine the Investigating Officer and give the defence a proper opportunity to cross-examine him according to law. The complainant's request to increase the sentence was dismissed.
This case matters because it reinforces those accused of crimes have a legal right to properly challenge witness credibility, and courts must follow prescribed evidentiary procedures strictly.
