Muhammad Musa v. Hamid Ali,

CLC 2012 254 · Balochistan High Court

This case was about a property dispute in which the petitioners claimed ownership of land, partly through a gift and partly through inherited rights. During the trial, they tried to submit will and gift deeds as evidence, but did so years after the lawsuit began and well past the stage required by law for filing documents. The trial court refused to allow these late documents, and the petitioners challenged that refusal before the Balochistan High Court through a revision petition.

The High Court first addressed whether such an interlocutory order could even be challenged through a revision petition. It ruled that revision is not limited only to final judgments or decrees, but can also apply to interim orders that affect the substantial rights of the parties, even if no appeal is available against them.

On the main issue, the court found that the petitioners failed to justify why they waited so long to produce the documents. They knew about these documents earlier but gave no reasonable explanation for the delay. Since procedural rules require timely submission of documents, and exceptions are only allowed when good cause is shown, the court held that the trial judge had rightly rejected the late submission.

The High Court therefore dismissed the revision petition, upholding the trial court's decision. The case clarifies that courts have discretion to reject late evidence unless a valid reason for delay is shown, and that such rulings can still be reviewed through revision.
