M/s Lahore Dioceson Trust v. Shafi Jan,
CLC 2012 202 · Balochistan High Court
This case involves a property dispute in Chaman, Balochistan, where the Lahore Diocesan Trust Association and two members of the Christian community sued several people for declaration, injunction, possession, and recovery of money over church land and buildings they claimed were forcibly occupied and illegally built upon.
After evidence had been recorded, including statements from four of the trust's witnesses, the trust filed an application asking the court's permission to produce certain additional documents. The case was fixed for arguments on that application, but on the relevant date no one appeared for the trust and the matter was adjourned. On the next date, instead of deciding the pending application, the trial court dismissed the entire suit for lack of interest, treating it as if the suit itself, not just the application, was up for hearing.
The Balochistan High Court found this to be a serious error. The trial court had confused what was actually before it: only the application needed a decision that day, and at most that application could have been dismissed for non-appearance. The suit itself could not be thrown out under the procedural rules the trial court relied on. The High Court declared the trial court's order void and illegal, set it aside, and sent the case back for the pending application to be decided first, after which the suit should proceed to a proper decision on its merits within a set time. The case highlights the importance of courts correctly identifying what matter is actually scheduled before dismissing a case.
