Mir Mitah Khan v. Government of Balochistan,
CLC 2012 1988 · Balochistan High Court
A man applied for a government job (Microform Technician) in the National Assembly Secretariat, Islamabad, under Balochistan's reserved quota. When he wasn't appointed, he filed a civil suit in Quetta asking the court to declare him eligible and qualified for the post, to stop the post being re-advertised or given to someone else, and to direct his appointment.
The trial court in Quetta dismissed his suit at the outset, without examining its merits, ruling that it lacked territorial jurisdiction since the job, the advertisement's origin, the application submission, and the test were all connected to Islamabad. The appellate court agreed. The petitioner then challenged this before the Balochistan High Court.
The High Court disagreed on the jurisdiction point, noting that since the job advertisement appeared in a Quetta newspaper and the petitioner applied from Quetta, part of the cause of action did arise in Quetta, so the courts below were wrong to say they had no jurisdiction.
However, the High Court still dismissed the case on a different ground: to seek a declaration under the Specific Relief Act, a person must show an existing legal right, not just a hope or candidacy for a job. Being a job applicant does not create a legal right to appointment, and appointment decisions rest solely with the hiring authority. Since no violation of law was shown, the suit was not legally maintainable regardless of jurisdiction.
This case clarifies that job applicants generally cannot sue for a declaration of entitlement to a government post merely because they applied and believe they are qualified.
