Mst. Faiqa Abdul Hayee v. Chairman BISE,

CLC 2012 1958 · Balochistan High Court

This case is about a woman who asked a court to officially change her date of birth on her school records and secondary school certificate. She claimed her actual birth date was 25 December 1973, but her maternal uncle had mistakenly recorded it as 25 January 1970 when he enrolled her in school. She said she only discovered this error recently, after looking through her father's old diaries, and filed her lawsuit soon after finding out.

The trial court and the first appellate court both rejected her case, ruling that it was filed too late (barred by limitation law) and that she had not proven her claim with solid evidence. She then brought the matter to the Balochistan High Court.

The High Court upheld the lower courts' decisions and dismissed her case. It noted that she had waited 23 years without explaining why she or her parents stayed silent about the alleged error for so long. She also never produced the diaries she said revealed the mistake. While her parents testified in her favor, the court said parental statements about a child's birth date, though important, are not enough on their own—they need independent supporting evidence, such as municipal birth registration records, which she failed to provide.

This case highlights how Pakistani courts require timely action and solid documentary proof—not just family testimony—when seeking to correct official records like a birth date, and reinforces that delays in filing such claims can be fatal to a case regardless of the underlying facts.
