Saeedullah Jaffar v. Sr Superintendent of Police,

CLC 2012 1911 · Balochistan High Court

This case concerns residents of Quetta who challenged the establishment of a local bus stand near their homes at the junction of Jinnah Road, Ramsay Road, and Adalat Road. They complained that the bus stand caused traffic jams, noise, filth, blocked access to their houses, and attracted crowds, vendors, and even public urination against their boundary walls, while also raising security concerns.

The dispute grew to involve a related issue: the old bus stand land, which had been acquired along with additional land for a new bus terminal, was instead being proposed for a massive commercial redevelopment by the Municipal Corporation, including nearly 786 shops, offices, a restaurant, and parking, with only a small portion left for actual bus operations.

The Balochistan High Court found this proposed redevelopment unlawful. It held that the tiny space left for buses would not have proper ventilation or room for buses to enter and exit safely, meaning the land's original public purpose as a transport amenity was being converted into private commercial use. The court ruled that public land acquired for a public amenity cannot be diverted for private profit by public authorities, and that such action violated local government laws and constitutional protections. The petition was accepted.

This judgment matters because it reinforces that government bodies cannot repurpose public land meant for essential services, like transport terminals, into private commercial ventures at the expense of public interest and residents' welfare.
