Ali Akbar Zehri v. Syed Gul Shah,
CLC 2012 190 · Balochistan High Court
This case concerns a dispute over a government-owned residential house in Quetta. The house had originally been allotted to a retired government employee, Razia Begum. After her retirement, her husband, Syed Gul Shah, claimed he was entitled to the allotment as her spouse and filed a civil suit for declaration and permanent injunction to prevent his eviction. However, before the suit was filed, the house had already been allotted to another person, Ali Akbar Zehri. The government also argued that Gul Shah could not be accommodated since he worked in a different department, and that he had since been transferred to another district.
The Balochistan High Court held that under the relevant law and allotment rules, a transfer to another station automatically revokes a person's claim to official residence. Since Gul Shah had been transferred, his claim no longer held. The court also found that before going to civil court, a person must first pursue the remedy available under the allotment rules by approaching the designated authority (such as the Chief Secretary) with any grievance. Since Gul Shah had not done this, his suit was premature and not legally competent, so it was dismissed. The court clarified, however, that the law barring court intervention only restricts temporary injunctions, not the right to file a declaratory suit itself. This case highlights the importance of exhausting proper administrative remedies before seeking court relief in government housing allotment disputes.
