Syed Ahmed Jan V. Anjuman-e-Islamia, Balochistan,
CLC 2012 179 · Balochistan High Court
This case involved a long-running dispute between shopkeepers (tenants) in Quetta and Anjuman-e-Islamia, Balochistan, a welfare society that owned the land on which the tenants had built and operated shops since around 1967. The society filed eviction applications, arguing it needed the land to construct a multi-storeyed building and had obtained official municipal approval for this construction. The Rent Controller ordered the tenants to vacate within four months, but also directed the landlord to provide them equivalent-sized shops in the newly built plaza once completed. The tenants appealed, arguing they had spent decades building their shops and installing expensive machinery at their own cost, and that eviction would destroy their livelihoods without adequate compensation.
The Balochistan High Court dismissed the tenants' appeals, finding that the landlord had genuinely established its need for the land and had properly obtained all necessary government permissions to build. The tenants had not disputed the landlord's ownership or its right to redevelop. However, recognizing that tenants would suffer real losses from having to demolish their existing shops and structures, and that the original order hadn't fixed fair rent for the new space, the Court added a protective condition: the landlord must charge tenants 30% less than prevailing market rent when they move into the new building.
This case matters because it balances a property owner's right to redevelop land against the practical hardships faced by long-term tenants, while confirming that appellate courts reviewing rent eviction orders have the same powers as courts hearing regular civil appeals.
