Bibi Amina & others v. Muhammad Iqbal & others,

CLC 2012 1699 · Balochistan High Court

This case involved a property dispute over a shop and basement in Quetta. The plaintiffs (grandchildren of Nasrullah Khan) claimed their grandfather, originally a tenant, had entered into a sale agreement in 1999 to purchase the shop and basement for Rs. 25 lac, and that most of the price had been paid. They sued for a court declaration of ownership, enforcement of the sale agreement, possession, and an injunction, after the property owner allegedly refused to formally transfer the property despite payments.

The trial court sent the disputed sale agreement to a handwriting expert, who found that the signatures on it were forged. Based on this, the trial court dismissed the plaintiffs' suit. On appeal, the Balochistan High Court upheld that decision. It found that sending the document for expert examination was a reasonable and legally sound step. It also noted that the sale agreement was never registered, and under the Stamp Act, an unregistered, insufficiently stamped document could not even be admitted as evidence, let alone used to prove ownership of property worth Rs. 25 lac. The court concluded the plaintiffs' claims were fabricated and unsupported, and that no legal right to the property could arise from such a defective document. The appeal was dismissed, and the original ruling stood.

This case highlights how strict legal requirements—like proper registration and stamping of property agreements—can determine the outcome of ownership disputes, regardless of claimed payments or possession.
