I.G Police of Balochistan v. Ghulam Rasool,

CLC 2012 1645 · Balochistan High Court

This case involved a land dispute in Kalat, Balochistan. Ghulam Rasool claimed he was the lawful owner of a piece of land that the police department had allegedly occupied illegally in 1996. He sued for declaration of ownership, possession, and a permanent injunction against the Inspector-General of Police and other officials.

The case had a long procedural history, going back and forth between the trial court (Qazi Kalat) and the appellate court (Majlis-e-Shoora), with the High Court itself remanding the matter once before for fresh evidence. Eventually, the trial court dismissed the suit, finding that the plaintiff failed to prove his ownership and possession claims with solid evidence. However, the appellate court reversed this and ruled in favor of Rasool, prompting the police department to file this revision petition before the Balochistan High Court.

The High Court sided with the police. It found that the appellate court had made serious errors: it relied on a document that was never formally tendered or proved in evidence, and it misread the record regarding possession, which actually showed continuous, uninterrupted control by the provincial government. The court also emphasized a broader legal principle—that a plaintiff's testimony must fully match the claims made in the written plaint; any inconsistency weakens the case.

As a result, the High Court set aside the appellate court's decision and restored the trial court's dismissal of the suit, ruling against Ghulam Rasool. This case underscores the importance of properly proving documents in court and maintaining consistency between pleadings and testimony.
