Datsun Motors v. Ain Ullah Agha,
CLC 2012 1577 · Balochistan High Court
This case is about a shop rental dispute in Quetta. The landlord filed for eviction of his tenant, a business called Datsun Motors, claiming he genuinely needed the shop for his own personal use. The Rent Controller agreed and ordered the tenant to vacate. The tenant appealed.
While the appeal was pending, the landlord died. The tenant's lawyer argued that since the landlord had died, his legal heirs could not benefit from the eviction order because the personal need was specific to the deceased landlord, not his heirs. The tenant also argued on the merits that the landlord hadn't genuinely needed the shop, and separately claimed he had paid goodwill money (Pagri) to a previous owner, so the eviction shouldn't be allowed.
The Balochistan High Court rejected these arguments. It explained that a decree (the court's formal order) creates a legal right, and once that right belongs to a person, it automatically passes to their legal heirs when they die - the heirs step into the deceased's shoes and can defend the decree in court. So the death of the landlord did not cancel or weaken the eviction order. The court also rejected the Pagri argument, since such informal goodwill payments aren't a legal transaction, and that issue was between the tenant and the previous owner, not the landlord's family.
The appeal was dismissed, meaning the eviction order stood, and the landlord's heirs could enforce it. This case clarifies that legal rights won through court decrees survive a person's death and pass to their heirs.
