Khalil Ahmed and others V. The State,
CLC 2012 1483 · Balochistan High Court
This case involved three men, Khalil Ahmed, Muhammad Ali alias Heera, and Mumtaz Brohi, convicted by an Anti-Terrorism Court in Turbat for kidnapping for ransom. The victims, two brothers traveling from Gwadar to Karachi, were abducted and their family was contacted demanding Rs. 5 crore in ransom. The trial court sentenced Muhammad Ali and Mumtaz Brohi to life imprisonment for abduction for ransom under the Penal Code and Anti-Terrorism Act, and Khalil Ahmed to life imprisonment for abetting the crime.
On appeal, the Balochistan High Court found a serious procedural flaw. When one of the accused was arrested later and joined the trial, the earlier prosecution witnesses were only recalled for cross-examination based on their previously recorded testimony, instead of having their full examination-in-chief repeated in his presence. The law requires that a witness's main testimony be recorded in the presence of every accused person, not just that they be made available for cross-examination. The court also noted that crucial mobile phone call-location data used to convict the accused had never been formally presented as evidence in court, which unfairly prejudiced the defense.
Because of these violations, the High Court set aside the convictions and sent the case back to the trial court for the witnesses to be properly re-examined. The judgment stresses that speedy justice must not come at the cost of fair and lawful trial procedure.
