Fazal Mir alias Zallai and another V. The State and another,
CLC 2012 1457 · Balochistan High Court
This case involved an appeal against a murder conviction from the Balochistan High Court. The accused, Fazal Mir alias Zallai, had been sentenced to death by a trial court for shooting and killing Saleh Muhammad, who was making ablution near a disputed piece of land. The dispute arose because the accused claimed ownership of the land and had, a day before the killing, tried to stop the deceased from working on it. When the deceased continued using the land, the accused fired at him and also allegedly fired shots toward the complainant and a witness.
The accused argued that the prosecution had not proven its case beyond reasonable doubt, pointing to issues like witness relationships with the deceased, a delay in filing the police report, and failure to recover the murder weapon. The High Court rejected these arguments, finding that relatives of a victim are not automatically "interested witnesses" unless they have a personal motive to falsely accuse someone, and that the failure to recover the weapon or minor delays in reporting did not undermine an otherwise credible, consistent account of the crime.
However, the Court found mitigating circumstances: the accused had fired only a single shot despite having the chance to fire more, and the killing followed provocation from a property dispute. Because of this, while his conviction was upheld, his death sentence was reduced to life imprisonment. The case highlights how courts weigh witness credibility and use mitigating factors to moderate sentencing in murder cases.
