Jamaluddin v. Haji Gul Khan,
CLC 2012 1353 · Balochistan High Court
This case involved a land dispute in Balochistan between two groups of relatives claiming shares in agricultural land in Mouza Olyani, Tehsil Barkhan. The plaintiffs, who said they were joint owners in possession of the land, filed a suit asking that the land be declared joint property and divided among the co-owners according to their shares. The defendants argued they had already been in separate possession of a quarter share for twenty years following a private partition, and they challenged whether the local court (Majlis-e-Shoora) even had the power to hear this kind of case.
The trial court had ruled in favour of the plaintiffs and ordered partition. On appeal, the Balochistan High Court disagreed. It held that since both sides agreed they were co-owners and there was no real dispute over title, the case was essentially about dividing shamilat (jointly owned) land. Under the West Pakistan Land Revenue Act, 1967, such partition matters must go through a Revenue Officer, not a civil court, unless a genuine question of title arises, in which case only that specific issue can go to civil court under Section 145 of the Act. Since this was a straightforward partition dispute, the civil court had no jurisdiction to decide it at all.
As a result, the High Court set aside the earlier judgment and dismissed the plaintiffs' suit entirely, sending the matter back to the proper revenue authorities. The case highlights the strict divide between revenue and civil court jurisdiction over land partition in Pakistan.
