Azizullah v. Mst. Hameeda Begum,
CLC 2012 1268 · Balochistan High Court
This case is about a property dispute over two pieces of land in Quetta. The original owner, Mst. Hameeda Begum, claimed that her adopted son, working together with another person, fraudulently sold her land without her real consent. The land then changed hands multiple times through a chain of sales before finally being bought by Aziz Ullah and another buyer, the petitioners in this case. Hameeda Begum sued to have all these sales cancelled and to have her ownership and possession restored. Both the trial court and the first appellate court ruled in her favour.
The petitioners then challenged these rulings, arguing they were innocent, good-faith buyers who had built houses on the land and invested money, and therefore should be protected under Section 41 of the Transfer of Property Act, which shields genuine buyers who purchase from someone appearing to be the rightful owner, provided they took reasonable care to verify ownership.
The High Court rejected this argument. It explained that to claim this protection, buyers must prove the seller appeared to be the true owner with the real owner's consent, and that they themselves acted carefully and in good faith. Here, the buyers' own sale documents contradicted their court statements, and there was no proof they had verified ownership before buying. Since two courts had already agreed on the facts, and the buyers failed to show any legal error, the High Court dismissed their petition, upholding the original owner's title.
