Bashir Ahmed and another V. The State and others,

CLC 2012 125 · Balochistan High Court

This case involved an appeal by a man convicted of murder under section 302(b) read with section 34 of the Pakistan Penal Code, alongside a revision petition seeking a harsher sentence for another accused. The murder allegedly arose from a family dispute over property between brothers, with one brother killed. The trial court had convicted the appellant to life imprisonment, while acquitting a co-accused.

The Balochistan High Court examined the evidence and found it seriously deficient. The prosecution relied almost entirely on the testimony of the deceased's widow, the sole eyewitness, whose account was uncorroborated by any independent evidence. No weapon was recovered from the accused, there was no forensic report, and the body had never been medically examined, so no medical evidence supported her version either. The court also noted the witness had a personal interest in the outcome due to an ongoing property dispute, and had improved her testimony over time to strengthen the case. The prosecution's argument that the accused's absconding proved guilt was rejected, since absconding alone does not establish guilt.

The court also stressed that any evidence not put to the accused during his examination under section 342 of the Criminal Procedure Code cannot be used against him. Since the co-accused had already been acquitted on the same evidence, the court found no basis for convicting this appellant either. It set aside his conviction and ordered his release, highlighting the importance of solid, corroborated evidence in murder cases.
