Pakistan Mobile Communication Ltd. v. Niamatullah Achakzai,

CLC 2012 12 · Balochistan High Court

This case involved a dispute between Pakistan Mobile Communication Ltd (Mobilink) and Naimatullah Achakzai, who had been appointed as a franchise to provide mobile services under a 2003 agreement. In 2007, Mobilink terminated the agreement, alleging Achakzai had violated its terms. Achakzai then sued for declaration, injunction, recovery of commission and money, and damages of Rs.5 crore. Mobilink asked the trial court to stay the suit, pointing to an arbitration clause in the franchise agreement requiring disputes to go to an arbitrator rather than court. The trial court rejected this request, so Mobilink appealed.

The Balochistan High Court ruled in Mobilink's favor. It held that since both parties had voluntarily agreed to resolve disputes through arbitration, they should be held to that agreement unless a strong reason existed to bypass it. The court found that the dispute-including the termination itself-arose directly from the agreement's terms and conditions, and so fell within the scope of the arbitration clause. This case reinforces the principle that arbitration clauses remain enforceable even after cont

بلوچستان ہائی کورٹ نے موبی لنک کے حق میں فیصلہ دیا۔ عدالت نے قرار دیا کہ چونکہ دونوں فریقین ن
