Liaquat v. Haji Allauddin,

CLC 2012 1104 · Balochistan High Court

This case concerns a landlord-tenant dispute under the West Pakistan Urban Rent Restriction Ordinance, 1959. The landlord, Haji Alla-ud-Din, sought to evict his tenant, Liaquat, from a shop on two grounds: that the tenant had defaulted in paying rent since September 2004, and that the landlord genuinely needed the shop for his son to start a spare parts business. The Rent Controller ruled in the landlord's favor on both grounds, ordering the tenant to vacate. The tenant appealed to the Balochistan High Court.

On the rent default issue, the High Court agreed with the lower court. The tenant claimed he had tried to pay rent by money order, which was refused, so he deposited it in court instead, but he could not prove this refusal by producing postal officials or records, so the default finding was upheld.

However, on the claim of genuine personal need, the High Court disagreed. It found that the landlord had filed several nearly identical eviction cases against other tenants using the same grounds and even the same alleged default dates, suggesting a pattern of bad faith aimed at re-renting vacated shops at higher rents. Notably, the landlord's son, for whom the shop was supposedly needed, never testified to support the claim. The court ruled this showed the landlord's need was not genuine, and set aside that part of the eviction order. This case illustrates how courts scrutinize landlords' motives, not just tenants' compliance, in eviction disputes.
