Yaqoob V. Sawali,

CLC 2012 1002 · Balochistan High Court

This case involved a land dispute in Balochistan over roughly 30 acres of agricultural property. The petitioners (Yaqoob and others) claimed the land was their ancestral property, cultivated through tenants since their forefathers' time, and said it had been wrongly recorded in the respondents' names during a new land settlement in 2001. The respondents (Sawali and another) claimed the land had been recorded in their names for about 35 years and that they were in possession of it.

The trial court (Qazi) dismissed the plaintiffs' suit, saying their witnesses gave contradictory and inaccurate descriptions of the property's boundaries, which under Sharia principles made their testimony unreliable. The appellate body (Majlis-e-Shoora) upheld this dismissal. The High Court had earlier sent the case back for a more detailed judgment, but the Majlis-e-Shoora still failed to properly examine the evidence.

The Balochistan High Court found that both lower courts had ignored the plaintiffs' actual evidence and based their decisions on incorrect assumptions rather than the record. Although courts are usually reluctant to interfere with matching decisions from two lower courts, the High Court held that when such decisions are not grounded in evidence and produce injustice, correction is necessary. It set aside both judgments and ruled in favor of the plaintiffs, holding their case had been proven.
