Muhammad Saleem v. Muhammad Ehsan-ul-Haque Ghauri,

CLC 2011 73 · Balochistan High Court

This case involved a dispute over an ex parte decree, meaning a court judgment issued against defendants who did not appear in court. The respondent had sued the appellants for recovery of money and damages related to a coal supply contract. When the appellants could not be served through normal means, the court ordered service by publication in a newspaper. The trial court eventually decreed the case in the respondent's favor without the appellants participating.

Years later, when the respondent tried to execute the decree and attach the appellants' property, the appellants claimed they had never known about the case. They argued the respondent had deliberately arranged for the newspaper notice to appear in a publication with poor circulation in their area, amounting to fraud, and that they only learned of the decree when the execution proceedings began. They asked the court to set aside the decree and allow a retrial.

The Balochistan High Court rejected this argument. It found that the appellants had used the same address in other lawsuits they filed against the respondent in another city, showing they were already aware of the decree and had deliberately delayed acting on it. The court held that under the Limitation Act, the clock for challenging such a decree starts once the party becomes aware of it, and the appellants had failed to prove any fraud. Since the trial court had properly evaluated the facts, the appeal was dismissed, upholding the original decree.
