Nazar Muhammad v. Niaz Muhammad,

CLC 2011 615 · Balochistan High Court

This case involved a long-running property dispute over a pre-emption suit, where the buyers of land (respondents) sought to acquire it back from the original purchasers (petitioners) under pre-emption rights. The trial court decreed in favor of the respondents in 2004, and the appellate court upheld this but ordered them to pay the market price for the property. After several rounds of appeals, including to the Supreme Court, the case was sent back to determine the exact purchase price and payment deadline. While the amount of purchase money was still being contested before the Balochistan High Court, the executing court went ahead and ordered mutation of land records and possession transfer in favor of the respondents.

The petitioners challenged this, arguing the execution was premature since the purchase price hadn't been finally decided, and also that the execution application was filed beyond the legal time limit. The High Court agreed, holding that under the Civil Procedure Code and Limitation Act, a decree-holder must apply for execution within a specific timeframe, and more importantly, in pre-emption cases, ownership only transfers once the court-assessed purchase money is actually paid. Since the price itself was still under litigation, the right to execute the decree had not yet arisen. The Court found the lower courts erred in allowing execution prematurely and set aside their orders, ruling in favor of the petitioners. This case underscores that in pre-emption suits, execution cannot proceed until the purchase price is conclusively settled.
