Chakar Ali Khan Rind v. Govt; of Balochistan,

CLC 2011 601 · Balochistan High Court

This case comes from the Balochistan High Court and deals with flood protection for villagers living near the Mirani Dam. The petitioner, representing residents of Kosh Kalat and nearby areas along the Kech River, asked the court to order authorities to build a protective wall, since heavy floods in June 2007 had caused major damage to homes and land. He argued that officials had promised to build such a wall but never did, and that the dam's spillway was too small to safely release floodwater.

The government responded that the damage was caused by an unprecedented cyclone-driven rainfall, not by any failure on its part, and that a flood protection project costing Rs. 84 million had already been approved and was partly completed.

The court first rejected the government's technical objection that the petitioner lacked proper authority to represent the community, noting he had consistently acted on their behalf. It held that the State has a constitutional duty under Articles 9 and 24 to protect people's life, liberty and property, and that residents facing flood threats were entitled to compensation and rehabilitation if harmed. However, the court said it could not, in this type of petition, calculate the exact compensation owed to the petitioner. It disposed of the case by allowing him to file a separate civil suit for compensation if he wished.

The ruling reinforces that constitutional rights to life and property include a government duty to protect citizens from disasters like floods, even though monetary claims must go through ordinary courts.
