Muhammad Ali alias Khamisa V. The State,

CLC 2011 1953 · Balochistan High Court

This case is about a criminal appeal filed by Muhammad Ali alias Khamisa, who was convicted by a trial court in Balochistan for murdering two people, Muhammad Aslam and Mst. Amiran, in December 2005. According to the prosecution, the appellant and two other accused ambushed Aslam with firearms and killed him, and shortly afterward also shot and killed Mst. Amiran, allegedly because of her suspected illicit relationship with the deceased Aslam. The appellant was convicted under section 302(b) of the Pakistan Penal Code and sentenced to life imprisonment on two counts, along with fines payable to the victims' heirs.

On appeal, the Balochistan High Court reviewed the evidence, including eyewitness testimony from the complainant (father of one victim), medical reports, recovery of the murder weapon from the appellant, and a positive ballistic expert report. The court found the complainant's testimony credible and consistent despite cross-examination, and ruled that being related to the victim did not automatically make him an unreliable witness, since he had no personal grudge against the accused. The court also noted the appellant never testified to explain his side.

The High Court upheld the trial court's conviction, finding no grounds to interfere with the judgment. This case illustrates how courts evaluate eyewitness credibility, corroborating forensic evidence, and the significance of an accused's silence when assessing guilt in serious criminal cases.
