Mahesh Kumar Chawala v. Abdul Karim,

CLC 2011 1844 · Balochistan High Court

This case involved a landlord, Haji Abdul Karim, who sought to evict his tenant, Mahesh Kumar Chawala, from a shop under the Balochistan Urban Rent Restriction Ordinance, 1959. The landlord's eviction application relied on two grounds: that the tenant had illegally sublet the shop to someone else, and that the landlord needed the shop for his own son's personal use, since the son was unemployed. The Rent Controller initially ruled in the landlord's favor and ordered the tenant to vacate.

The tenant appealed to the Balochistan High Court, which reversed the decision. The Court found serious flaws in the landlord's case. First, the landlord never even named which son needed the shop, and that son never appeared in court to testify about his own need for the property, making it impossible to verify the claim or later enforce any eviction order. Second, on the subletting claim, the landlord failed to name the alleged sublessee as a party to the case or specify when the subletting occurred, which meant this ground could not be properly argued or proven. The Court also noted that the tenant had a legitimate partnership agreement with the person allegedly occupying the shop, and that the landlord's witnesses gave unreliable, essentially copied testimony.

As a result, the High Court set aside the eviction order and dismissed the landlord's application entirely. The case highlights that landlords must provide specific, verifiable evidence and follow proper procedure when seeking to evict tenants for subletting or personal need.
