Ghulam Akbar v. Abdul Raziq Khan,

CLC 2011 1734 · Balochistan High Court

This case, decided by the Balochistan High Court in 2011, involved a dispute among the heirs of a deceased man, Haji Abdullah Jan, over several properties he left behind. Some of his children and grandchildren sued other family members, seeking a declaration of their inheritance rights, cancellation of certain revenue mutations, partition, possession, and other relief. The defendants claimed the properties were not part of the inheritance because the deceased had gifted them to certain heirs before his death, and they relied mainly on entries in the land revenue record to prove this gift.

The trial court had partly decided in favour of the plaintiffs, and both sides appealed.

The High Court ruled largely in favour of the plaintiffs. It held that a claim of a preferential gift, which effectively cuts other legal heirs out of their inheritance, must be proved strictly and convincingly by those claiming the gift. Here, the persons claiming the gift did not appear in court themselves, and their attorney's testimony failed to establish the essential requirements of a valid Islamic gift—offer, acceptance, and delivery of possession. Mere revenue record entries, the court explained, are administrative formalities and do not by themselves prove ownership or transfer of property. Since the alleged gift was not properly proved, the court ordered that the properties be distributed among all the legal heirs according to their Islamic (Sharai) inheritance shares. The judgment reinforces that family members cannot be deprived of inheritance rights based on weak or unproven gift claims.
