Shakil Ahmed Baloch v. Returning Officer,
CLC 2011 1641 · Balochistan High Court
This case involved a dispute over the 2010-15 election for the Balochistan Bar Council. The petitioner and another candidate tied with 41 votes each, so the Returning Officer resolved it by drawing lots, as allowed under election rules, and the other candidate won. The petitioner challenged this outcome, arguing that two votes counted in his opponent's favor should have been invalid, one cast by a government servant who wasn't eligible to vote, and another marked with a tick instead of the required cross.
However, before examining these merits, the court had to decide whether it even had jurisdiction to hear the case. The respondent argued the Election Tribunal was improperly formed since the Bar Council never requested its creation. The judge rejected this objection, clarifying that under the applicable rules, the Chief Justice must appoint a High Court judge as Election Tribunal for such disputes, and no formal request from the Bar Council is legally required.
Despite confirming jurisdiction, the court found a different procedural flaw: the petitioner had filed his complaint directly with the Election Tribunal, bypassing the required step of first submitting a written objection to the Chairman of the Provincial Bar Council, who should have then forwarded it to the Tribunal. Because this mandatory procedure was skipped, the court ruled that proper legal process wasn't followed and returned the petition, allowing it to be refiled correctly rather than deciding the underlying vote-counting dispute.
