Akhtar Muhammad v. Malik Abdul Hameed,
CLC 2011 1379 · Balochistan High Court
This case is about a long-running dispute over a right of way. The petitioners claimed they had used a passage over land owned by the respondents for 27 years, and said the respondents blocked it by constructing something on it. The respondents denied any such right of way existed and argued the case should not proceed because it involved a "public nuisance" issue, which under the law requires prior written permission from the Advocate-General before filing suit, and also required following certain procedural rules for representative suits. Both the trial court and the appellate court agreed with the respondents and rejected the plaint without a full trial.
The Balochistan High Court disagreed. It held that the petitioners were claiming a private right of way for their personal use, not a right belonging to the general public over a recognized public road. Since no public right was involved, and only a private easement claim was being made, the case did not amount to a public nuisance, and therefore no special permission was needed to file the suit. The court noted that whether the easement actually existed still needed to be proven through evidence at trial.
The High Court set aside the lower courts' orders and sent the case back to the trial court to be decided properly, after hearing evidence. This matters because it clarifies that private disputes over rights of way don't automatically become "public nuisance" cases just because they occur on land others might use, and such technical objections shouldn't block a party from having their case heard on its merits.
