Niaz Gul v. Malik Munir Ahmed,
CLC 2011 1150 · Balochistan High Court
This case involved a dispute between a landlord and tenant over a rented shop. The landlord, Malik Munir Ahmed, filed an eviction application against the tenant, Niaz Gul, claiming the shop had been rented out at Rs.500 per month and that the tenant had stopped paying rent since July 2004, making him a defaulter. The tenant disputed the landlord tenant relationship, claiming a different, older tenancy arrangement at a much lower rent under a separate agreement, and argued he had been depositing rent with the court's Civil Nazir.
The Rent Controller initially dismissed the eviction case, but on an earlier appeal, the High Court sent the matter back for additional inquiry, including identifying the shop's actual number and the real rent amount. After further evidence, including a site inspection report showing the tenant had tried to alter the shop's number, and proof that rent receipts had been tampered with, the Rent Controller found that the tenant was depositing far less rent (Rs.150) than the actual amount owed (Rs.500), and ordered eviction for default in rent payment.
The tenant appealed again, but the Balochistan High Court upheld the eviction order. The court found no error, misreading of evidence, or legal flaw in the Rent Controller's decision, concluding that the tenant had deliberately underpaid rent and tampered with documents. This case highlights how courts scrutinize evidence carefully in rent disputes and uphold landlords' rights when tenants default or manipulate records to underpay rent.
