Obaidullah v. Haji Sher Muhammad,

CLC 2011 1105 · Balochistan High Court

This case involved a dispute over a rented hotel and godown (warehouse) in Kuchlak, Balochistan. The tenant, Obaidullah, had leased the property from the respondent's father in 1988. He claimed that a water channel behind the property's back wall caused the wall to collapse in 2001, damaging nine rooms of the godown, and that despite being asked, the landlord failed to fix the problem or take responsibility for repairs. Obaidullah sued for a declaration and a permanent injunction.

The landlord's side denied this version, arguing instead that Obaidullah had illegally sublet the godown to another person who used it to keep sheep, causing the damage himself through misuse rather than any water channel.

Both the trial court and the first appellate court examined the evidence and witness testimony and ruled against Obaidullah, finding his claims about the water channel unproven, while evidence suggested the property had been misused after subletting. Obaidullah then filed this revision petition before the Balochistan High Court, arguing that the lower courts had misread the evidence and ignored the landlord's legal duty to maintain the rented premises.

Since there was no clear legal error or misreading of evidence, the concurrent findings of the lower courts were left undisturbed. This case illustrates the limited scope of revisional jur
