Ganj Bibi v. Muhammad Younas,

CLC 2011 1062 · Balochistan High Court

This case involved a mother, Ganj Bibi, who sought to be legally appointed as the guardian of her young son, Muhammad Yousaf, after her marriage to the child's father, Muhammad Younas, ended through khula (a form of divorce initiated by the wife). Although she already had physical custody of the child, who was only a few months old at the time of filing, she wanted formal recognition as his legal guardian.

The trial court dismissed her application, and she appealed to the Balochistan High Court. The High Court upheld the dismissal. It explained that under the Guardians and Wards Act, 1890, particularly Section 19(b), a court cannot appoint someone else as guardian of a minor if the child's father is alive and not shown to be unfit for the role. The judge noted that while a mother is entitled to custody of a young child under Islamic law, custody and legal guardianship are different matters. Since Ganj Bibi already had custody and had not presented any evidence that the father was unfit or had tried to take the child away from her, there was no legal basis to remove the father's guardianship rights or appoint her instead.

This case clarifies the distinction between custody and guardianship under Pakistani law, showing that having physical custody does not automatically entitle a parent to formal guardianship, especially when the father remains fit and willing to fulfill that role.
