Muhammad Yaqoob Nasar v. Muhammad Israr Tareen,
CLC 2010 912 · Balochistan High Court
This case concerns an election petition challenging the results of a 2008 election in Balochistan, filed before the Election Tribunal at the Balochistan High Court. Before the merits could be examined, the winning candidate (respondent) filed an application arguing that the petition itself was legally defective and should be thrown out without further hearing.
The core issue was technical but important: under the Representation of the People Act, 1976, every election petition must be signed and "verified" by the petitioner in the manner required by the Code of Civil Procedure. This means the petitioner must clearly state which parts of the petition he knows to be true from his own personal knowledge, and which parts he believes to be true based on information from others. He must also properly swear this verification on oath before an authorized person, and any documents attached to the petition must likewise be signed and verified.
The judge examined the petitioner's actual verification statement and found it generic and incomplete—it did not distinguish between facts known personally and facts believed on information, and the oath was not properly attested as required. Relying on Supreme Court precedents, the judge held that this requirement is mandatory, not merely a technicality, and that failure to comply is a "fatal defect" leading to automatic dismissal.
As a result, the election petition was dismissed without examining whether the election result itself was actually flawed—illustrating how strict procedural compliance can determine the fate of election challenges in Pakistan.
