Malik Zaheer & others v. Muhammad Saleem & othr,

CLC 2010 642 · Balochistan High Court

This case involved four related civil revision petitions from Balochistan concerning a land dispute in Nushki/Dalbandin. The petitioners claimed they owned certain agricultural land, including areas with date-tree gardens, as ancestral property inherited from their forefathers, and said they had been in peaceful possession until the respondents began interfering. The trial court (Qazi, Dalbandin) initially ruled in favour of the petitioners, granting declaration and possession. However, on appeal, the Majlis-e-Shoora, Nushki, reversed this decision and dismissed the suit. The petitioners then challenged that reversal before the Balochistan High Court.

The High Court upheld the appellate court's decision and dismissed all four revision petitions. It found that although petitioners claimed the land was ancestral property, none of their witnesses actually testified to this fact. The court held that mere possession of property does not automatically create a legal right to claim ownership through a declaration suit — specific legal ingredients must be proven, which were missing here. It also clarified that a plaintiff cannot win simply because the defendant failed to prove their own case; the plaintiff must independently prove their claim. The court further noted that once limitation begins running on a cause of action, withdrawing and refiling a suit does not restart the clock. This judgment reinforces the principle that possession alone is insufficient to establish ownership rights, and plaintiffs bear the burden of proving their own case with solid evidence.

ہائی کورٹ نے اپیلیٹ کورٹ کے فیصلے کو برقرار رکھتے ہوئے چاروں نظرثانی درخواستیں خارج کر دیں۔ عدالت ن
