Abdul Qadir & others v. Nadeem Javed & others,
CLC 2010 631 · Balochistan High Court
This case from the Balochistan High Court dealt with a family dispute over ancestral property left by a man named Samandar Khan after his death in 1962-63. His daughter (from his first marriage) and her son filed a lawsuit against the children from his second marriage, claiming their rightful inheritance share in the property, which included several houses. The daughter also claimed she had transferred part of her share to her son.
The defendants argued that the plaintiffs had already been paid cash for their shares long ago and therefore had no more claim to the property. Both the trial court and the first appellate court ruled in favor of the plaintiffs, ordering that the property be divided among all legal heirs.
The High Court, hearing this revision petition, upheld those decisions. It held that under Islamic inheritance law, legal heirs automatically become entitled to their share of a deceased person's property upon death, without needing any court order. Since the defendants admitted the property was ancestral but claimed they had already paid off the other heirs, the burden was on them to prove this settlement and payment actually happened with the heirs' free consent. They failed to provide convincing proof.
Because both lower courts had already carefully examined the evidence and reached the same conclusion, the High Court declined to interfere and dismissed the revision petition, reaffirming the plaintiffs' right to their inheritance share.
